PRIVACY NOTICE ROCA TEAM, S. A. DE C. V. (en lo sucesivo “ROCA” o “nosotros”) In compliance with the Federal Law on Protection of Personal Data Held by Individuals (hereinafter “The Law”) and its Regulatory Law, we make available to our clients, suppliers and/or service providers, collaborators, ex-collaborators and third parties (hereinafter “The Owner”) this Privacy Notice.

  1. Identity and address of “ROCA”

“ROCA”, with address at Av. San Jerónimo no. 310 Floor 17-1, San Jerónimo neighborhood, C.P. 64640, Monterrey, Nuevo León, México, is committed to the protection of your personal data, assuming responsibility for its use, handling, storage and confidentiality in accordance with the provisions of the Law and we inform you that these will be used solely and exclusively for the following purposes and in accordance with this Privacy Notice.

  1. Purposes of the processing of Personal Data

We will use the Personal Data that we collect from you for one, some or all of the main purposes described below (before and hereinafter, Personal Data), to:

A) Customers:

  •      Verify and confirm your identity;
  •      Provide the services and products required by you;
  •      Register in our systems as a client;
  •      Celebration of service contract;
  •      Send quotes for our products and/or services, whenever you require it;
  •      Respond to and respond to requests for doubts, comments and quotes that you request from “ROCA”;
  •      Prepare, send and collect tax invoices online;

  •      Process, investigate, follow up and respond to the request that you request from us in the exercise of the Rights of access, rectification, cancellation or opposition (hereinafter, “ARCO Rights”).

C)Candidates, Collaborators and Ex-collaborators:

We will use the Personal Data that we collect from you for the following main purposes, for the Recruitment Process and selection of hired Candidates and Collaborators, as well as for Ex-collaborators to terminate an employment relationship.

  •      Comply with the obligations derived from a labor relationship that you have or will have and enforce and/or execute a contract;
  •      Comply with fiscal, labor and social security obligations;
  •      Carry out the evaluation process for recruitment, selection and hiring to evaluate that you have the necessary skills to fill a vacant position within the company, in accordance with the policies that have been established;
  •      Contact and inform you of the status of your recruitment and selection process;
  •      Establish a labor relationship and prepare, manage and update the file that is generated;
  •      Make your payroll payment;
  •      Attend requirements issued by the competent authority, and process, investigate and respond to the request for “ARCO Rights”.

We inform you that you are being videotaped by security cameras, these images will be used for security reasons for our clients, suppliers, visitors, candidates, collaborators and ex-collaborators.

We inform you that “ROCA” does not collect personal data for Secondary or accessory Purposes, that is, to “send you generalized and/or personalized advertising and for marketing, statistical and commercial prospecting purposes”.

Your Personal Data will be processed only for the time necessary in order to fulfill the purposes described in this Privacy Notice that is made available to you, and where appropriate, as established by the respective legal provisions.

Security and Protection of Personal Data

The Personal Data that you provide to “ROCA” will be duly protected through technological, physical and administrative security measures, as well as mechanisms designed to protect personal data from damage, loss, alteration, destruction or unauthorized use, access or processing. . Your Personal Data will only be available to personnel authorized by “ROCA” for the processing of the information and only for the purposes described in this notice.

  1. The Personal Data Processed

The Personal Data that we collect from you, for the purposes described in this Privacy Notice, are collected as follows:

  1. Personally, when you provide them to one of our collaborators physically at the address of “ROCA”.
  2. b) Directly, when you provide them to us by phone or by email.
  1. c) Indirectly, through other sources that are permitted by the Law.

To carry out the purposes described in this Privacy Notice, we will use some, some or all of the following personal data:

Clients: name, address, landline and/or mobile phone, email, handwritten signature. For invoicing: company name tax address email (s), Federal Taxpayer Registry including homoclave.

Suppliers and/or service providers: name or business name, company name, contact name within the company, Federal Taxpayer Registry including homoclave, CURP, copy of constitutive registration, copy of power of attorney, account statements bank, proof of address, landline and / or mobile phone and email, handwritten signature.

Collaborators: In addition to the above, the following data is collected in copies: official identification issued by the National Electoral Institute, valid proof of address (not older than 3 months); Social security registration, proof of INFONAVIT credit withholding, photograph, signature and fingerprint granted in employment contract.

Former employees: In addition to the aforementioned, a handwritten signature and/or fingerprint is collected both in the resignation submitted by the employee and in the termination agreement of the employment relationship.

  1. Sensitive Personal Data

We inform you that “ROCA” does not collect sensitive Personal Data, understood as those personal data that affect the most intimate sphere of “The Owner”, or whose improper use may give rise to discrimination or entail a serious risk for it. In particular, those that may reveal aspects such as ethnic origin, present and future state of health, genetic information, religious, philosophical and moral beliefs, union affiliation, political opinions, sexual preference are considered sensitive.

  1. Mechanism so that “The Holder” can express his refusal for secondary or accessory purposes

We inform you that we do not provide any mechanism to express your refusal for secondary purposes, since we do not carry out any type of advertising, marketing, statistics and commercial prospecting.

  1. Transfer of Personal Data

Your personal data will only be transferred to national third parties that are commercially related to “ROCA” to fulfill the purposes described in the Privacy Notice, so “ROCA” may transfer some, some or all of your personal data in the cases provided for and authorized by the Law in accordance with the following: (i) To the Tax Administration Service, by virtue of the processes of issuing and sending tax receipts over the Internet or to our managers for the issuance of tax invoices over the Internet; (ii) To legal entities or any Entity that are part of the same economic control group to which “ROCA” belongs and/or; (iii) To affiliated or non-affiliated companies that assist, support or help “ROCA”.

  1. Consent for transfer of Personal Data

We inform you that for the transfer of personal data indicated in the previous numeral we do not require your consent, since such transfers are necessary for the legal relationship or of any other nature that you have or may have.

  1. Means to exercise your ARCO Rights.

We inform you that you have the right to know what personal data we have about you, what we use them for and the conditions of use that we give them (Access). Likewise, it is your right to request the correction of your personal information in case it is outdated, inaccurate or incomplete (Rectification); that we eliminate it from our records or databases when it considers that it is not being used in accordance with the principles, duties and obligations set forth in the regulations (Cancellation); as well as oppose the use of your personal data for specific purposes (Opposition). These rights are known as ARCO Rights.

For the exercise of any of the ARCO Rights, you may request reports through the following service channels:

  • Directly at the address of “ROCA” indicated in number one of this notice, where we will provide you with the application form for the exercise of ARCO Rights, as well as the requirements and necessary documentation that must be attached to it.
  • By email to the following email address: so that through this means “ROCA” sends you the ARCO Rights application form to be filled out and scanned, in addition to attaching the documents that identify you as the owner and any other that facilitates the location of the personal data of the person exercising the right, in accordance with this Privacy Notice.

Procedure and Requirements for the Exercise of ARCO Rights:

To exercise the aforementioned rights, your request must be accompanied by at least the following information:

1) Full name as well as full address;

2) Documents that prove the identity of “The Owner”;

3) Clear and precise description of the Personal Data with respect to which one seeks to exercise any of the rights mentioned by the Law.

4) Any other element or document that facilitates the location of Personal Data;

5) Provide the documentation that supports your request;

“ROCA” will notify “The Owner”, within a maximum period of twenty days, counted from the date on which the request for access, rectification, cancellation or opposition by “The Owner” was received, so that if it results appropriate, it becomes effective within the fifteen days following the date on which the response is communicated. The aforementioned deadlines may be extended only once for an equal period, as long as the circumstances of the case justify it. The delivery of Personal Data will be free, and “The Owner” must cover only the justified shipping costs or the cost of reproduction in copies or other formats.

  1. Mechanism for the Holder to revoke his consent for the use of his Personal Data

You can revoke the consent that, where appropriate, you have given us for the processing of your Personal Data; however, it is important that you take into account that not in all cases we will be able to attend to your request or terminate the use immediately, since it is possible that due to some legal obligation we may need to continue processing your Personal Data. Likewise, you must consider that for certain purposes, the revocation of your consent will imply the conclusion of your legal relationship or of any nature with us.

To revoke your consent, you must follow the procedure mentioned in the previous point (8. Means and procedures to exercise ARCO Rights), attaching the documents that identify you as the owner and any other that facilitates the location of the data and indicating specifically for what personal data is requesting its revocation.
